00:00Along with the left-right issue and questioning of the legality of the arrest of former President Rodrigo Duterte,

00:06Father Angelio Aquino, Dean of San Beto Graduate School of Law, gave the legal basis for this.

00:13In the program Mike Abelive, Aquino explained the two legal basis of the arrest of former President Duterte.

00:21First is the membership of the country in Rome State Supreme Court in 2011,

00:25where it was stated in Article 127 that even if the Philippines withdrew from membership,

00:32it still has an obligation to do and will continue to do so in the processes that are included in the cases

00:39where there is a jurisdiction or power to judge it.

00:42Second is what is under Republic Act 9851 or Article 17,

00:48where it is allowed for the government to investigate and prosecute in favor of the International Tribunal.

00:57According to Aquino, this is not seen as politics or propaganda

01:02because this is a legal matter where former President Rodrigo Duterte should answer the accusations against him

01:09related to the bloody war on drugs of his administration.

01:15I also want to advise the public,

01:18that it's okay for everyone to express their feelings,

01:29but the moment they cross the line and they call for the overthrow of the government,

01:36then it becomes sedition and it becomes criminal.
