00:00Malacanang denied the justice for the victims of the war on drugs of the previous administration.

00:06As for the arrest of the former president,

00:09an ICC-accredited lawyer said that it is not considered warrantless

00:14because the electronic arrest warrant from the ICC is valid.

00:17Kenneth Pacientes is in the center of the news.

00:23Even the International Criminal Court accredited lawyer,

00:26Atty. Joel Butuyan, said that the process of arresting the former president, Rodrigo Duterte, was followed.

00:33The court order from the Philippine court itself was ignored yesterday in the Senate hearing

00:39before the former president was arrested.

00:41Butuyan explained that there is no power of a domestic judicial authority

00:45to question the arrest warrant from the international body like the ICC.

00:50What he can do is to point out who is the subject of the arrest warrant

00:55and to ensure that his rights are respected,

00:58which was given to the former president.

01:00He was charged with Miranda Rights.

01:02So that's pursuant to our domestic law on arrest.

01:06And then he has a lawyer there.

01:09We fully complied with our domestic law

01:13because the Philippine government has the discretion to directly surrender the suspect to the international court.

01:29Atty. Butuyan also argued that the arrest warrant from the former president was not warrantless

01:34because the electronic arrest warrant from the ICC is valid.

01:38According to our law, the physical warrant of arrest is not needed at the time of the arrest.

01:45For as long as there exists a warrant of arrest,

01:48in fact, we can have an e-warrant as per our rules of court.

01:57Even in the ICC, the physical warrant of arrest is not needed

02:03because it can be e-warranted.

02:05In fact, the proceedings of the ICC, even their trials, are all paperless.

02:10Everything is e-documented.

02:18Because of that, it is not important if the former president received a diffusion notice or a red notice when he was arrested.

02:26So whether it's a diffusion or a red notice,

02:31it doesn't matter because the red notice is given as a shotgun to all members of the ICC.

02:41The diffusion is usually country to country.

02:44But regardless of the terminology, the ICC is just a coordinating agency, an organization.

02:52What's important is that the ICC gave us a valid warrant of arrest, regardless of how it gave it to us.

02:59But is it possible for the former president to return to the country?

03:02I don't think he will be able to return.

03:04Either the case will be dismissed or he will be given an interim release,

03:08which I think is very, very slim.

03:12The palace also gave a warrant to the administration to give justice to the victims of the drug war.
