00:17ICC Accredited Lawyer, Atty. Joel Butuyan, believes that any appeal that is currently pending in the Supreme Court

00:25is moot and academic regarding the return of former President Rodrigo Duterte.

00:30According to Butuyan, the case is currently pending in the International Criminal Court of Bolag.

00:33The former President's case is currently in its jurisdiction and is under their custody.

00:39It is now in the ICC.

00:41According to Atty. Butuyan, if the case is to be dismissed,

00:44or if the former President will not give an interim release to return to the Philippines,

00:48the ICC Accredited Lawyer stated that there is a slim chance that President Duterte will not be able to return.

00:57Until there is a ruling or decision from the court,

01:00only then will it be known if the former President will be able to return or not.

01:06Until there is a ruling from the ICC, because it is in the jurisdiction of the ICC,

01:09so it's going to be the ICC which is going to say if he will return or not.

01:14So it's either the case will be dismissed or he will be given an interim release

01:18that he will return here, which I think is very, very slim.

01:22Meanwhile, Atty. Butuyan is waiting for the arguments of the defense

01:26in the formal moment of facing the former President's litigation.

01:30Aside from questioning the validity of the arrest warrant,

01:33Atty. Butuyan said that he is also checking the safety of the defense team of our President

01:38on how to implement the warrant of arrest.

01:42It is certain that he will also open the argument in the jurisdiction of the ICC

01:46in the case of the former President while insisting that the Philippines is no longer a member of the ICC.

01:52First of all, the validity of the issuance of the warrant of arrest,

01:58the validity of the implementation of the warrant of arrest,

02:02what happened in the Philippines,

02:03and then they will also question the jurisdiction of the ICC over Mr. Duterte.

02:12And they will argue that since we are no longer a member, the jurisdiction of the ICC is no longer there.

02:18Atty. Butuyan said that under Article 59, Domestic Law,

02:22the implementation of the warrant of arrest will be left to him.

02:28including the appropriate respect in the case of the arrest
