00:00country's safe again, we're going to keep moving forward.

00:08And I would just add, you know, where was the district court judge when all these folks

00:11were coming into the United States, right?

00:14And so this idea that you're going to have a judge or even, you know, the left of the

00:17country is now siding, first they sided with illegal aliens, and now they're siding with

00:21terrorists instead of with the American people.

00:24So I think Tom's exactly right.

00:26And I think, you know, the American people, by and large, support what the president is

00:31doing here.

00:32Governor, now you have some thoughts on the judge.

00:35Well, look, I mean, well, first of all, the US Supreme Court had a chance to nip all this

00:44in the butt about a month ago, and they could have just been aggressive, put these district

00:51judges in their place.

00:52But, you know, the three liberal justices, they're always going to be against no matter

00:56what.

00:57And then of the six others, you know, a lot of them aren't reliable.

01:01Thomas is reliable, Alito's reliable.

01:04But you had a 5-4 where the Chief Justice and Justice Barrett sided with the liberals,

01:10kept these cases alive.

01:13And it was a different case than the one just there.

01:15But the principle is, are we ruled by the consent of the governed under elections and

01:22under a written constitution, or are we ruled by a district judge in D.C., Hawaii, wherever

01:29the hell they can shop for a judge to find somebody.

01:33And then that trumps everything that is in the Constitution in terms of executive powers,

01:39because that's what they'll keep doing if you let that happen.

01:42So the US Supreme Court needs to put a kibosh on it.

01:46Forget about just whether a judge should even be involved in this to begin with.

01:50Clearly, if you have one case, judge rules against the government, that shouldn't be

01:55a nationwide injunction where the government can't act in all the other 99.9 percent of

02:01the cases.

02:02And so the US Supreme Court could reel that in if they wanted to, and maybe they will.

02:07But you know, Congress, people say, oh, these courts are out of control.

02:11They've been out of control for a long time.

02:14It got worse under Trump 45.

02:16We knew this was going to happen.

02:18Like this is the most predictable thing that this is what the left would do.

02:23Congress has the authority to strip the courts of jurisdiction over certain issues.

02:29They can say you can't hear any case involving the removal of an illegal alien or the removal

02:35of certain classes.

02:36They could do that if they wanted to do it.

02:39They haven't done that.

02:40They haven't been aggressive on it.

02:41But that's plain in the Constitution.

02:44When Jefferson became president, they had had problems with judges.

02:48They just eliminated these judgeships that they had problems with.

02:51They didn't even bother.

02:52So like none of these courts exist as a matter, other than the Supreme Court, none of the

02:57other courts even exist as a matter of constitutional right.

03:01That's purely the discretion of Congress to create and then set the jurisdiction.

03:06So we were talking about this earlier before we came out.

03:09If you look at how our government, not just on immigration, on everything, how our constitutional

03:15system has really been transfigured in a bad way over many, many decades, the root of the

03:20problem is Congress's fecklessness.

03:23The reason why you have so much debt, continuing resolutions, a massive bureaucracy run amok

03:28is Congress doesn't use the power of the purse to rein it in.

03:31The reason why you have these judges doing what they're doing is Congress has not used

03:35the authority in the Constitution to take political issues away from the courts and

03:41make sure that that's reserved in the executive branch.

03:44So I don't know, I mean, basically, if Congress isn't going to do anything, then you're hoping

03:49that the US Supreme Court will ultimately put the kibosh on this.

03:53And maybe they will.

03:55And I think that the arguments that the Trump administration will put forward are the right

03:59arguments.

04:01But I've also seen them put forward the right arguments already.

04:04And the Supreme Court has not been willing to adopt those arguments yet.

04:08So we'll see what happens.

04:10But if they don't put the kibosh on this, then you're just going to have four years

04:13of trying to find the most liberal judge you can file a lawsuit.

04:18They'll say nationwide injunction.

04:20And then your hands are tied from doing the job that the American people elected the president

04:26to do.
