00:00In spite of the left-right issue and questioning of the legality of the arrest of former President Rodrigo Duterte,
00:06Father Rangelio Aquino, Dean of the San Beda Graduate School of Law, clarified the legal basis of the case.
00:13In the Mike Abbey Live program, Aquino also gave the two legal basis of the arrest of former President Duterte.
00:22The first is the membership of the country in the Rome Statute of 2011,
00:26where it is stated in Article 127 that even if the Philippines withdraws from membership,
00:31it still has an obligation to do and will continue to deal with the processes
00:35including cases where there is a jurisdiction or power to judge it.
00:39The second is under Republic Act 9851, Article 17,
00:44where it is stated that the investigation and prosecution favored by the International Tribunal
00:48may be dismissed or submitted by the government.
