New Delhi, May 15, 2025 (ANI): On President Murmu questioning SC's deadline ruling in State bills, Senior Advocate Siddharth Luthra said, "...This reference to my mind is to determine what is the way going forward, to what extent the Supreme Court will direct governors & presidents to act, to the extent that they will determine and sit over jurisdictions of governors and presidents. The issue today is - can a governor or the President sit over a legislation? Can it render a governance null and void? It is an issue about federalism and also about how we are going to deal with the rights of citizens to have governance. If we have constitutional authorities obstructing or nullifying the process of making laws by the governance, then are we not depriving the citizens of governance?"

00:00that there is an issue of a question on the separation of powers principle and that's a
00:07very important question that has been raised please don't just look at the reference look
00:11at the underlying issues that arise in the reference the scope of the supreme court power
00:15under article 142 is also been raised having said that this reference to my mind is to determine
00:22what is the way going forward to what extent will the supreme court direct governments governors
00:27and presidents to act and to the extent that they will determine and sit over the jurisdictions of
00:32governors and presidents do keep in mind that decisions of governors and presidents in the
00:36context of remission have already been made justiciable so whether it is a pardon or a remission
00:41these decisions are already considered but on very narrow parameters the issue today is can a governor
00:49and that is something which will have to be answered by the court can a governor or any other or the
00:54honorable president sit over a legislation and can it render governance uh null and void the issue
01:02here is not just about the the powers of the president and the governor the center and the state
01:09it's a federalism issue it is also an issue about how we are going to deal with the rights of the
01:16citizen to have governance after all a citizen elects people when the citizen elects his members of
01:21parliament and the party that is in power in the state of the center the citizen expects governance
01:26from them governance is one of part of governance is the making of laws which the citizen desires
01:31through the voice spoken of the members of parliament or members of the legislative assembly and if we have
01:37constitutional authorities nullifying or obstructing or sitting over that process then are we not
01:43depriving the citizen of governance and i think that is really one of the primary issues which i hope
01:47will be raised and dealt with in this issue can authorities stop the right of a citizen to good governance
