00:00The Federal Court has reserved judgment on the appeals of six men, including ex-military
00:06Dr. Arkuna Segarin, sentenced to death for the 2015 murder of Deputy Public Prosecutor
00:11Kevin Marais.
00:13Chief Justice Tunku Maimun Tuanmat, with Justices Abang Iskandar Abang Hashim and Rozaria Bujang,
00:19said the bench needed time to consider the oral and written submissions from both defense
00:23and prosecution.
00:25Deputy Public Prosecutor Usaini Abdul Karim argued against adopting Singapore's dual-crimes
00:30principle, suggested by lawyer Amir Hamza Arshad, who represents S. Nimalan.
00:35Amir claimed that a key witness, G. Gunasegarin, testified the accused only planned to abduct
00:41Marais, not kill him, and urged the court to charge Nimalan with abduction or disposal of
00:46the body instead.
00:47Last year, the Court of Appeal had upheld the death sentences of Gunasegarin, S. Ravi Chandran,
00:53Dineshwarin, A.K. Dinesh Kumar, M. Vishwanath, and Nimalan.
00:58Defense lawyers contended that the murder charge was not proven and argued their clients should
01:02be found guilty only of abduction.
01:04The High Court originally sentenced them to death on July 10, 2020, after Marais' body
01:09was found in an oil drum filled with cement in Subakjaya.
