00:00A political analyst said Sabah Deputy Chief Minister Shahelmi Yahya could lose his seat in the Dewan Rakyat if he decides to contest the upcoming state election under a rival party's ticket.

00:14Azmi Hassan of Academy Nusantara said with Shahelmi currently serving a six-year suspension from UMNO, he is ineligible to run as their candidate and may need to run under a different party.

00:27However, Azmi pointed out that under UMNO's constitution, Shahelmi will cease to be a member if he contests under another banner.

00:36Clause 20.11.1 of UMNO's constitution states that party members who are MPs or state assemblymen will automatically lose their membership if they turn independent or join a coalition which UMNO is not aligned to.

00:50Clause 20.11.2 provides that they will automatically lose their membership if they contest under the banner of another party or as independents.

01:00An UMNO leader speaking on condition of anonymity confirmed the position under the party's constitution, adding that losing membership triggers Article 49, Subsection 1A2 of the federal constitution.

01:15Article 49, Subsection 1A2 states that an MP will lose his seat in the Dewan Rakyat if they cease to be a member of the party under which they were elected.
