00:10Exclusively talked about by GMA Integrated News, the spokesperson of the International Criminal Court or ICC,

00:18he discussed the concept of interim release or temporary release requested by the former President Rodrigo Duterte.

00:26Maris Umali live from the Cape of the Netherlands. Maris.

00:35Vicky, it is the right of an accused here in the International Criminal Court to receive an interim release or temporary release.

00:42But there are conditions that must be fulfilled before this can be implemented.

00:45And it also depends on the evidence and judgment if this can be given.

00:49The priority now of the field of the former President Rodrigo Duterte is to get an interim release or temporary release from the International Criminal Court.

01:02In the exclusive interview of GMA Integrated News, the ICC spokesperson, Dr. Fadi L. Abdala, said

01:09that the mechanism of interim release is based on respecting the principle of presumption of innocence.

01:15But when a suspect is arrested, the defense has to show something.

01:20That presumption of innocence means that the principle should be the freedom of the suspects and not their detention.

01:27When the judges issue an arrest warrant, that means that they believe that the arrest of this specific individual is necessary,

01:33either because he or she are still committing crimes, or because he or she would not appear before the court and cooperate with it

01:41if the court issued an assumption to appear and not an arrest warrant.

01:45Or because they believe that maybe without arresting this individual, they may be creating obstacles or threats to the proceedings, to the investigation, or to the witnesses.

01:56So they have to justify that.

01:59In the ICC process, when a suspect is to be faced, summons or warrant of arrest can be issued.

02:07When summons are issued, the judges believe who the suspect is going to face.

02:12If the warrant of arrest is issued, the court has an excuse.

02:36There is a different set of conditions that needs to be checked.

02:40These conditions are what the court will look at if it will follow.

02:44In the past cases, the movement of the suspect was limited.

02:48It is prohibited to inform the investigation.

02:50Witnesses are not allowed to speak and he cannot make public statements.

02:58In the case of Duterte, his family wants him to return to the Philippines.

03:03Dr. Al-Abdallah said that it is important if the country will allow the disappearance of the suspect

03:09so that it can help and follow the conditions related to the interim release.

03:14Does this country accept this release?

03:16If the court is ordering certain conditions and measures to be put in place

03:21to ensure that he will not be in contact with this or that,

03:24that he will not be threatening the investigation,

03:26that he will be brought again before the court when the judges order,

03:30does the country accept these conditions and measures or not, and so on.

03:36So as a matter of general principle,

03:39all these conditions and questions need to be discussed before the judges

03:45and then the judges will decide whether or not to grant an interim release with or without conditions as I mentioned.

03:55It is also in the hands of the ICC judges where the country will grant custody of the suspect.

04:00Now as a matter of principle, the ICC can enter into general agreements for interim release

04:08or for other purposes with different states,

04:11but can also enter into ad hoc agreements with certain states for specific cases.

04:17One of the issues of Duterte's camp is his way of arresting.

04:21The ICC clearly stated that no matter how Duterte was arrested,

04:25he is now under the jurisdiction of the ICC.

04:28And the crimes that happened and are being complained about by the ICC

04:32were committed by a part of the Philippines under the Rome Statute.

04:35So crimes allegedly committed during this period in the Philippines were under the ICC jurisdiction

04:41and remain under the ICC jurisdiction.

04:44Vicky, there were instances where an interim release was granted,

04:52but it does not mean that it will automatically be granted.

04:57It still depends on the evidence that will be presented to the court.

05:00Dr. Abdala also clarified that it will not affect the decisions of the court

05:06the steps that will be taken by the supporters of former President Rodrigo Duterte.

05:11The judges will only be able to make a decision based on the evidence that will be presented to the court.
