00:00The trial judge who convicted Muar MP Saeed Sadiq Saeed Abdul Rahman of corruption and
00:06money laundering charges committed serious misdirection in failing to consider all evidence
00:11before him, the Court of Appeal heard today.
00:15Counsel Hisham Tipo Teix said the failure to weigh the evidence of defense witnesses
00:19against the prosecution at the close of the defense case was a non-compliance of Section
00:24182A sub 1 of the Criminal Procedure Code.
00:28Hisham pointed out that a prosecution witness, former Bersati Youth Assistant Treasurer Rafiq
00:33Hakim Razali, testified that the instruction to withdraw RM1 million from a bank account
00:38came from Saeed Sadiq, who was then Bersati Youth Chief.
00:42He said the witness also admitted under cross-examination by a lawyer for the appellant that he caved
00:47under pressure from the Malaysian Anti-Corruption Commission and gave a statement to implicate
00:52Saeed Sadiq.
00:53The lawyer said another defense witness, former Bersati Youth Information Chief Wulia Akamah
00:58Husamuddin, supported Saeed Sadiq's testimony that there was no such instruction to withdraw
01:03the money.
01:04On November 9, 2023, Saeed Sadiq was found guilty of abetting a criminal breach of trust
01:10amounting to RM1 million and dishonest misappropriation of RM120,000.
