00:00DOJ will serve as the lawyer of the government of the Supreme Court regarding the arrest of former President Rodrigo Duterte

00:08upon the refusal of the Solicitor General to answer the writ of habeas corpus petition submitted by the children of the former President.

00:20Justice Secretary Jesus Crispin Remulia is ready to face the Supreme Court

00:27to defend the government regarding the arrest and deportation of former President Rodrigo Duterte to the Netherlands.

00:33This is after the DOJ said that they will be the lawyers of the government officials in the Supreme Court

00:40because of the refusal of the office of the Solicitor General to answer the writ of habeas corpus petition submitted by the Duterte brothers.

00:49Remulia also said that they already have laws ready to be filed against the petition

00:54and they still believe that the situation of Duterte in the Hague was not fulfilled by the law in the Philippines.

01:01For a possible round of legal arguments, if need be, because the way that I've said it already, it's a done deal.

01:09The man is already under the jurisdiction of the ICC.

01:15It is extra-territorial. It's in another country.

01:18So, it's beyond the scope of our legal system already.

01:23We have already turned over the person arrested.

01:28Some of the laws that Remulia supports are Republic Act No. 9851 or the Philippine law

01:35on crimes against international humanitarian law

01:38and also the Petition v. Cayetano that was the case in the Supreme Court until the Philippines left the ICC.

01:46I believe that in the court's discussions, when the decision was made in that case,

01:53they really believe that we have a responsibility in the ICC until 2019.

02:00Remulia also vowed against the use of the field of Duterte in the provision of the Rome Statute

02:06that it is their right to seek legal remedies in the country before sending the former president to the Hague.

02:14Kalihim said,

02:15They said that they built it in the ICC.

02:19We still go with the principle of comity that we still respect the ICC.

02:26That's 125 countries grouped together forming the International Tribunal Court.

02:33We respect that but we don't need to follow every single law and order there.

02:45Meanwhile, not only in the field of Duterte, Remulia also challenged the former presidential spokesperson,

02:52Attorney Harry Roque, to be a Filipino and a lawyer and go home to the Philippines

02:59to face the complaints against her.

03:08because of his possible involvement in the Pogo operation in the country back then.
