00:00Now that the former President Rodrigo Duterte is in the custody of the ICC,
00:04it is expected that he will start his case of crimes against humanity.
00:10This is what Harley Valbuena reported.
00:14After being put under the custody of the International Criminal Court in The Hague, Netherlands
00:19because of the case of crimes against humanity,
00:21what will be the outcome of the former President Rodrigo Duterte?
00:26According to ICC Assistant to Counsel, Atty. Cristina Conti,
00:30it is expected that the pre-trial of the former President will start.
00:34There will be a verification of the identity of the person,
00:37the charges, the manner of arrest.
00:42It will be presented to the court.
00:44According to University of St. LaSalle College of Law Dean Ralph Sarmiento,
00:48the pre-trial of the former President Rodrigo Duterte may start
00:51even though the witnesses are not yet in The Hague.
00:54But for the law expert,
00:55it is unlikely that Duterte will be able to return home for a long time.
00:59This is because the ICC does not give the right to appeal
01:03to the defendants.
01:05The only thing Duterte can do
01:07is to apply for an interim release.
01:09But this is only for a short distance
01:12and he will not be allowed to go far from the ICC facility.
01:16In the International Criminal Court, there is no right to bail.
01:19So he can request an interim release pending trial.
01:24Normally, you will only be allowed within a certain range
01:30which will still be subject to the supervision of the court.
01:34Even though Duterte was granted temporary release
01:37due to his medical condition,
01:39he will only be allowed to receive treatment inside the ICC facility
01:43or other medical facilities
01:45but he is still under the protection of the International Court.
01:48According to Kina Conti and Sarmiento,
01:50the ICC's bail period is limited to two to eight years.
01:56If he is found guilty,
01:58Duterte can be sentenced to up to 30 years in prison.
02:02It is also impossible for him to be in prison in the Philippines
02:05because the country has already left the ICC.
02:09From the volunteer state parties,
02:10the International Criminal Court is the most appropriate state
02:15that can enforce the sentence.
02:18If there is no volunteer or there is no appropriate state party,
02:22then the sentence will have to be served at the facility at the ICC.
