00:00The family of Duterte went to the Supreme Court
00:03to ban the Senate from continuing the impeachment trial
00:07against Vice President Sara Duterte.
00:10The Senate Minority Leader wrote to the Senate President
00:13to tell him that the impeachment should be done immediately.
00:17Witness, Ma'am Gonzalez.
00:23In the last session on February 5,
00:25the Senate was asked to transmit to the Senate
00:27the articles of impeachment against Vice President Sara Duterte.
00:30The Senate President, Chief Escudero, said
00:33that they cannot start the impeachment trial
00:36while the session of the Congress is on break.
00:38But in the letter of Senate Minority Leader Coco Pimentel to Escudero,
00:42he insisted that the Senate should conduct the impeachment trial immediately.
00:46In the letter, the provision of the Constitution states
00:48that the Senate should conduct the impeachment trial
00:52if it receives articles of impeachment from the Camera.
00:56It means that it should be done immediately.
00:59Senator Risa Hontiveros confirmed this.
01:02The order is clear to us
01:04that once the articles of impeachment are transmitted to us,
01:07like what happened,
01:09we will immediately convene.
01:11Escudero has yet to comment on this.
01:13Senator Aimee Marcos said
01:15that the Constitution was not passed immediately
01:18and that there is a petition from the Supreme Court related to this.
01:21If the impeachment trial already started,
01:23she will not be inhibited even if she is a friend of the Vice President.
01:27I don't think it's necessary.
01:29We are fully aware of our duties as senators
01:33and we'll study all the evidence that will be provided
01:37and rule and vote on all that.
01:43Senator Bato de la Rosa will also wait for the decision of the Supreme Court.
01:47I think the Supreme Court can interpret the Constitution.
01:51If they give the right interpretation of the Constitution,
01:56I don't think the Supreme Court will direct us to do our job
02:00as said by our Senate President.
02:05We will do that job in the proper time.
02:08There are two petitions from the Supreme Court.
02:10Last Friday, one petition was submitted
02:12asking the Senate to immediately start the impeachment trial.
02:16The court gave the Senate 10 days to comment on this.
02:20It was treated as an urgent case.
02:23This is also obvious from the fact that the Supreme Court
02:26gave them a non-extendable period of 10 days to comment.
02:29Impeachment is a nationwide concern
02:33that will be treated with urgency because of the gravity of the matter.
02:37We asked the Senate to comment on this.
02:40Earlier, a petition from the Supreme Court
02:43was submitted to the allies of the Duterte family.
02:46They asked for an impeachment complaint against Bice
02:49and for the Senate to prohibit this.
02:52According to Atty. Israeli Totorion,
02:54the impeachment complaint is defective
02:57because it violates the provision
02:59that only one impeachment complaint
03:01can be filed against an official within a year.
03:05Three impeachment complaints have already been filed against Bice
03:09and a one-year ban should be imposed.
03:12The fourth was based on a verified impeachment complaint
03:15filed in the Senate.
03:17Vice President Duterte was not given due process
03:20and the congressmen were not given the right time
03:23to study the impeachment complaint.
03:26There was only around three hours
03:29between 12 o'clock to 3.15
03:32before it was included in the additional house business reference.
03:38By that time, we feel and we have reasons to believe
03:43that some of the congressmen were not even able to
03:47peruse the complaint as well as assess the evidences
03:51attached in the impeachment complaint.
03:53We also asked the camera to comment.
03:55According to the spokesperson of the Supreme Court,
03:58they will immediately act on the petition.
04:00In these petitions, the Supreme Court acts on the matter
04:03by either requiring the parties to comment on the petition.
04:06For GMA Integrated News, I'm Mav Gonzalez, your witness.
